Terms and Conditions
These Terms and Conditions govern use of setthetablekitchens.com and purchases from Set The Table LLC. By placing an order, the customer agrees to these terms and the policies linked at checkout.
Eligibility and acceptance
Customers must be at least 18 years old or act with the permission of a parent or legal guardian. The customer must provide complete and accurate contact, payment, and fulfillment information. An automated order confirmation shows that Set The Table received the request; it does not override menu availability, capacity, permit requirements, payment authorization, or fraud review. Set The Table may accept, reject, or cancel an order for a lawful business, safety, or compliance reason.
Service model
Set The Table prepares limited-quantity meals for scheduled pickup or delivery. Set The Table does not offer dine-in service or walk-in ordering. Public food service is subject to all required permits and approvals. Available meals, dates, portions, pickup times, delivery windows, ZIP codes, and fees are those displayed at checkout when the order is placed.
Orders and capacity
Orders are subject to menu availability and production capacity. The website may close a meal, portion, service date, pickup time, delivery window, or service area when capacity is reached. Customer-facing pages will not display the number of meals remaining. An unavailable selection may appear as “Tables Full.” Placing multiple items in a cart does not reserve them until checkout is completed and payment is authorized.
Prices payment and taxes
All orders must be prepaid through the payment methods shown at checkout. Prices, delivery fees, discounts, and applicable taxes are displayed before payment. Set The Table does not accept payment at pickup or delivery. Set The Table does not request or store full payment-card numbers through customer service, email, text message, or website chat. Payment processing is handled by the payment provider identified during checkout.
Menu descriptions and substitutions
Set The Table works to describe meals accurately. Photographs are illustrative, and appearance may vary. Ingredient availability may require a reasonable substitution of comparable quality. Set The Table will not knowingly make a material substitution that introduces a newly declared major allergen without notifying the affected customer and offering an appropriate option. Portion names are Comfort Lite, Comfort, and Premium. Every meal includes dessert; Comfort Lite and Comfort include one dessert, and Premium includes two desserts unless a specific promotion clearly states otherwise.
Customer instructions
The customer is responsible for choosing the correct meal, portion, service date, fulfillment method, and available time. Delivery customers must provide a complete address, working telephone number, access instructions, and an authorized recipient or approved safe-drop location. Set The Table is not responsible for delay or failed handoff caused by incorrect information, restricted access, an unavailable recipient, or an unsafe delivery location.
Promotions and free offers
A promotion may have separate eligibility, quantity, date, and redemption rules. Unless the promotion states otherwise, offers have no cash value, may not be transferred or combined, and end when the stated quantity or period is exhausted. Set The Table may correct an obvious pricing or promotional error before fulfillment and will offer cancellation and a full refund if the customer does not accept the correction.
Food safety and allergens
Customers must review the Allergen and Cross Contact Notice before ordering. Meals are prepared in a shared commercial kitchen that handles major allergens. Set The Table cannot guarantee that any meal is free from an allergen or cross-contact. Customers with a food allergy, celiac disease, or other serious dietary restriction should contact Set The Table before ordering and should not rely solely on website chat or automated responses.
Website use and intellectual property
Website content, recipes, photographs owned by Set The Table, logos, graphics, and original written material are owned by or licensed to Set The Table. Customers may use the website only for lawful personal ordering and information. Users may not interfere with the website, attempt unauthorized access, scrape or copy substantial content, submit false orders, or misuse another person’s information.
Third party services
The website may rely on third parties for hosting, payment processing, mapping, email, text messaging, analytics, or other functions. A third party’s separate terms may apply to its service. Set The Table remains responsible for its own representations and obligations but does not control an independent provider’s systems or network availability.
Disclaimer and limits
Set The Table does not exclude liability that cannot lawfully be excluded. To the fullest extent permitted by law, Set The Table is not liable for indirect, incidental, special, or consequential losses arising from website interruption, customer-provided errors, third-party outages, or events outside Set The Table’s reasonable control. This limitation does not apply to gross negligence, willful misconduct, personal injury caused by Set The Table, or any right that cannot be waived. For a claim concerning an order, any recoverable contract damages will not exceed the amount the customer paid for the affected order, except where the law requires otherwise.
Governing law and changes
Alabama law governs these terms, without applying rules that would require another jurisdiction’s law. Any court proceeding must be brought in a court with jurisdiction in Mobile County, Alabama, unless applicable law requires another forum. If one provision is unenforceable, the remaining provisions continue to apply. Set The Table may revise these terms prospectively by posting an updated version date. The terms in effect when an order is placed govern that order unless the customer agrees otherwise.
